This Website (hereinafter "Website”) was created, is owned and operated by the successors of the artist Manuel Amado, holders of copyright in their artistic works (hereinafter referred to as "Successors”), governing their use by these Terms of Use.

The Website aims to disseminate the artistic works created by the artist Manuel Amado of a purely informative and entertaining nature to its visitors, without any commercial character.

The User of the Website ("User”) acknowledges that he accepts its Terms of Use by using the Website.

The Successors reserve the right, at any time, without prior notice and with immediate effect, to modify, add, update or eliminate, partially or totally, these Terms of Use.

The User should periodically check these Terms of Use to confirm whether any updates or changes have been made. If you do not agree with any of the rules of use, you should not use the Website.

Access to the Website is not subject to registration. Successors reserve the exclusive right to suspend access to the Website or its services at any time, in whole or in part, in particular (but not exclusively), when managing, maintaining, repairing, altering or modernizing operations without any prior notice.

During the use of the Website, the User may not:

A) Make available any illegal, false, misleading, threatening, malicious, abusive, defamatory, injurious, invasive privacy, racially, ethically or morally condemnable, harmful or detrimental to the dignity of people or harmful to minors, or even that may negatively affect the image of the Successors;

B) Provide information or any content that violates the rights of third parties, namely any intellectual or industrial property rights or image rights;

C) Make available or transmit any material that contains or may contain viruses, worms, defects, trojan horses or other item or computer codes, files or programs that are likely to interrupt, destroy or limit the functionality of any equipment or computer system ( hardware or software) or communications equipment;

D) Use or explore, for commercial purposes or that are commercialized in any way, the Website or any part of it, including its contents, materials, functionalities or resources (any content made available may be accessed for personal use only);

E) Reproduce any image from the collection of Manuel Amado’s works made available for commercial purposes;

F) Remove any intellectual property notices, in particular, copyright, trademarks, logos or any industrial property notices;

G) Practising any fraudulent conduct, namely by pretending to be the owner of the Website or any content on it in order to obtain any economic and/or illicit advantage;

H) Make available or transmit any unsolicited or unauthorized content as SPAM;

I) Collect, store, make available, transmit, exploit or reproduce information about other Users or any other personal data holders (i.e., including usernames and/or e-mail addresses) for unauthorized purposes.

In general, the User must use the Website in a responsible, prudent and careful manner and must not disturb or degrade the continuity, integrity, and quality of its resources and functionalities. The User acknowledges that the use he makes of the Website is at his own risk, being solely responsible for any damage caused to his computer system and/or equipment or any other damages or losses, including loss or damage to data, resulting from the use of materials, content or information obtained, in any form, through the Website.

Also, the User acknowledges that, if he makes his data available, the Successors will make the best efforts to guarantee the security of the information in accordance with the Privacy Policy of the Website, but will not be responsible for the treatment of such information by third parties, it is not possible to eliminate the risks inherent to browsing data on an open network.

The User acknowledges that the Website, its structure and layout, the selection, organization and presentation of its content, including its functionalities and the software used, are owned by the Successors or have been duly licensed in favour of them.

All texts, comments, works, illustrations, works and images reproduced or represented on the Website are duly protected by the respective copyright for the whole world. Thus, and under the terms of the Code of Copyright and Related Rights, its use for private purposes will only be authorized, without prejudice to more restrictive provisions contained in the mentioned Code. Any reproduction or representation, either total or partial, of the Website or any elements included in it is strictly prohibited, under penalty of recourse to the competent legal means against anyone acting in this way.

The Successors are responsible for managing the design, layout of all information, content and materials on the Website, so they can, at any time, update, modify or delete any content, services, options or features, as well as modify its presentation and configuration and change their URLs.

The User is not authorized to transmit, communicate to the public, publish, make available to the public, modify, transform, copy, sell, use or distribute, in any way, the texts, images or other information contained in this Website, without prior written authorization from the Successors.

The User will access and use the contents and materials made available through this Website for non-commercial purposes upon clear identification of the respective source (and link to it). Any material changes must be identified, and it cannot be stated, or in any way inferred, that the use of the materials was authorized.

 

The use of the Website implies only the collection of personal data in case of contact of the Users for clarification requests related to the Website, its contents, and Manuel Amado’s work. If the User wishes to make a complaint, make comments or make suggestions, he can do so to the geral@manuelamado.com contact. The personal data provided through the contact geral@manuelamado.com will be treated in the terms defined in the Privacy and Cookies Policy, available on the Website.

The User may also choose to create a personal account to access certain website features and elements. In these cases, it will be necessary to provide a set of personal data that will be treated according to the Privacy and Cookies Policy.

The User must keep the access data to his Account confidential and must not, in particular, disclose it to third parties or browse under conditions that allow its decoding and copying by third parties. If the User forgets the access data to his Account, he must request a new password directly on the Website.

The Successors may cancel the Account if it fails to comply with the rules applicable to the Website’s use (namely the Terms of Use and the Privacy and Cookies Policy).

The Successors will send an e-mail informing them that their Account has been cancelled, using the contact e-mail address indicated by you when creating the Account. The Heirs are not responsible, directly or indirectly, for any damages resulting from the cancellation of your Account.

The information made available on the Website essentially aims to clarify and inform Users about aspects related to the life and works of Manuel Amado.

The Website was developed with the interests of different types of Users in mind. However, we cannot guarantee that the Website or any functionality available on it will meet any needs and expectations you have or serve your purposes.

Successors also do not guarantee that:

A) The results obtained through the use of the Website are correct, accurate, proper or reliable;

B) Any information or suggestion, of any kind, of the responsibility of the Successors, presented or made available on the Website, or obtained through its use, is current, rigorous, complete and free from errors - the Successors do not assume any legal duty in this matter ;

D) The qualities, functionalities or characteristics of the services, information, or other materials or content disclosed on the Website fulfil any Users’ expectations.

Successors will not be responsible for errors that may occur due to system irregularities, failure (temporary or permanent) of the Website, applications or other tools. Successors will not be liable for any damages resulting from improper use or the inability to use the Website.

Successors may provide links to pages of other entities. These websites are not owned or operated or controlled by the Successors, so they are not responsible, approve or in any way support or subscribe to the content of these websites or the websites associated with them. The establishment of links does not, under any circumstances, imply the existence of relations between the Successors and the owner of the web page to which the link refers.

Therefore, the Successors are not responsible for the legality, reliability or quality of any content available there, nor for the compliance with the legal rules applicable concerning the content available there, the use of these links being the sole responsibility of the Users.

Successors do not guarantee that the Website will operate uninterruptedly, be free of errors or flaws, or be available continuously.

Successors naturally do their best so that the Website does not have any type of virus or other elements dangerous to their computer or other devices from which they access the Website. However, since Successors cannot control the circulation of information over the Internet, it is impossible to guarantee that they do not contain any virus or other elements that could damage your computer.

To guarantee the Website’s security, Successors may, at any time and without the need for prior notice, take the necessary steps to ensure the integrity, security, continuity or quality of the Website, including restrictions or limitations on access.

Suppose any part or provision of these Terms of Use is not enforceable or is in conflict with applicable law. In such a case, the validity of the remaining parts or conditions will not be affected.
